Insured Companies

Gorvett & Bailey  are often instructed directly by your company’s insurer but that does not mean they do not understand your business. They take time to understand how your business works, what health and safety measures you have in place and what your expectations are in terms of the claim being brought against you. They appreciate that every business is different and adapt their services according to your company’s needs. 

You do not have to use the legal firm your insurer chooses for you. If you would prefer to instruct a legal adviser that is local to your business and equally competent then you can ask your insurers to instruct Gorvett & Bailey instead. They will still cover your legal costs and Gorvett & Bailey will act as their agent in bringing your claim to a satisfactory conclusion.

Uninsured Companies

If you find yourself uninsured, for whatever reason, Gorvett & Bailey can still act for your company on a private basis. They have extremely competitive hourly rates and once they are in receipt of your full file of papers, they will provide an initial, realistic breakdown of what the claim is likely to cost your company in terms of damages and costs within 48 hours or earlier, should circumstances dictate a faster response.


Law firms

It is exciting to see that law firms are changing the way they work to become more flexible and innovative when ensuring their client’s best interests are protected. Gorvett & Bailey offer a litigation service to law firms that find themselves requiring short-term assistance with their caseloads to cover things like  maternity leave, long-term sickness, leavers/beginner’s notice periods or excess workloads. Gorvett & Bailey have the experience to pick up any EL/PL claim, at any stage of proceedings and to do what is needed to bring a good result to your client. This can be on a fixed fee or competitive hourly rate depending on your requirements.

Individuals

Gorvett & Bailey also act on behalf of individuals that find themselves being sued.  Whilst rare, there has been a recent case in the press which highlights the sort of situation in which an uninsured individual can be sued for personal injury. This was a case involving a road cyclist and a pedestrian but this is not the only scenario. We have seen cases whereby the claimant, instead of using their right to compensation through the Criminal Injuries Compensation Authority sues an individual who has reasonable financial assets.

Mediation

Disputes happen for all sorts of reasons but before you enter into protracted and expensive court proceedings, why not consider using mediation instead? Gorvett & Bailey provide this service. 

Mediation is a voluntary and informal dispute settlement process that is run by a trained independent/impartial Mediator. The aim is to help the parties in conflict reach an amicable solution. Mediation often helps parties to understand the situation from all angles but it is not a platform to determine facts or decide which party is right or wrong. 

The purpose of mediation is for the parties to:

  • Explore the issues and orientate towards a joint problem-solving approach.
  • Have open and constructive conversations between those involved.
  • Try and find a fair solution that all parties feel comfortable with.

Mediation allows for the parties involved to make the final decision themselves on how to resolve the dispute. Mediation is always confidential and any concessions made in mediation cannot be used for any other purpose outside of the mediation. However, a resolution via mediation can be legally binding if both parties agree.
